Terms & Conditions

Please ensure you have read and understood the terms and conditions below before making a booking. Payment for your boat holiday confirms your understanding and acceptance of our terms and conditions .

Definitions and Interpretation
In these Terms and Conditions of Booking, unless the context requires otherwise, the following expressions have the following meanings:
"We", "Our", "Travel Organizer" – Stay Salty Ammare di Bisso Emiliano
"You", "Your", "Traveler" - All persons named in the booking
"Online", "Tour", "Sailing Holiday" - the rental of the sailboat you book with us.

 

The titles used in these Terms and Conditions of Booking are for convenience only and will not affect the interpretation of these Terms and Conditions. Words imparting the singular will include the plural and vice versa, and references to any gender will include the other gender.

The contract between the travel organizer and the traveler begins upon receipt of the booking deposit.

Currency
All monetary amounts are expressed in Euro (EUR €) and all payments include VAT and any other tax unless otherwise indicated.

 

Bookings
After making a booking with the Travel Organizer, the Traveler will be required to complete a group booking form and include each member of the travel group. It is the responsibility of the Traveler to ensure that every additional traveler in their group has read, understood, and accepted these terms and conditions.

A copy of the passport of each traveler must be provided to the Travel Organizer along with the completed group booking form.

 

Inclusions of the Offer
The Offer includes all services, accommodations, activities, and amenities explicitly specified and advertised by the Travel Organizer. Such inclusions are detailed in the respective advertising or promotional material provided. Any discrepancies or deviations from these advertised inclusions will be subject to mutual agreement.

 

Exclusions of the Offer
Services, amenities, activities, or any other arrangements explicitly indicated as "not included" in the advertising or promotional material are expressly excluded from this Offer. Travelers are advised to carefully review the "not included" section to understand the scope of exclusions. The Organizer has no obligation to provide services or performances classified as "not included" unless expressly agreed in writing.

Optional Extras
The Offer may present optional services or amenities that can be purchased by the Traveler at their discretion. These optional extras are clearly delineated as such in the advertising or promotional material. Travelers may choose to take advantage of these extras by voluntarily paying an additional fee as specified by the Travel Organizer. The provision of optional extras is subject to availability and may be subject to changes without notice.

 

Mandatory Extras
Certain services or expenses may be mandatory for Travelers at the time of boarding or as specified by the Travel Organizer. Such mandatory fees, where applicable, will be communicated to the Traveler before finalizing the Offer. Failure to pay mandatory fees may result in the denial of services or accommodations, at the discretion of the Travel Organizer.

 

Acceptance of Terms
By accepting the Offer, the Traveler acknowledges having read, understood, and agreed to abide by the terms and conditions outlined herein. The Traveler will be the point of contact for the Travel Organizer and will be responsible for keeping the group informed about all sailing arrangements.

This Offer is subject to the laws and regulations governing the jurisdiction in which the Travel Organizer operates. In the event of any dispute or disagreement arising from this Offer, the parties agree to resolve the matter through amicable negotiation or, if necessary, through legal recourse, before the Court of Palermo.

Cabin Assignments
At the time of booking a cabin spot (shared cabin) or a private cabin, we reserve the right to modify the cabin assignment. We respect cabin preferences; however, on rare occasions, we may need to mix cabin assignments to accommodate boat bookings. Generally, solo travelers will be paired by gender.

 

Payment
Unless otherwise agreed with the Travel Organizer, each traveler will be required to pay a deposit of 50% per booking to secure the requested departure dates.
For exclusive bookings of the entire vessel, a deposit of 50% is required.


All deposits must be made within five (5) working days (Monday to Friday) of the booking.

The balance will be due 30 days before the departure date. The specific date will be specified in the official Stay Salty Ammare offer issued at the time of booking confirmation.

If booking a date less than 30 days before the departure date, full payment will be required. Confirmation of the booking cannot be given until payment is received.

Payment must be made via bank transfer. When making payments, ensure that you cover all bank fees for international transfers. Payments will be made to Stay Salty Ammare or on the online platform used for booking, which will process payments and manage customer bookings; any additional costs incurred by them are not the responsibility of the Travel Organizer.

Itinerary
The skipper has the authority to modify the itinerary when and where deemed appropriate. This will occur for safety reasons or due to adverse weather conditions. Dangerous winds may necessitate taking a safe berth at the nearest port. This cost is the responsibility of the guest. If the group collectively requests a change to the itinerary, the decision in this regard will be at the discretion of the skipper.

Boarding and Disembarking
All sailing holidays of the travel organizer end at 9:00 AM on the following Saturday. This is the time to disembark from the sailboat. It is possible that the last night is spent at the dock and not at anchor; this cost is included in the price.

Check-in/Boarding Time
The boarding point/check-in time may vary for each week.
The check-in and boarding times may be different. Please refer to the welcome email for check-in and boarding times. We will conduct check-in and provide a safety briefing.

If you are late, we may arrange a water taxi (at your expense) or you may need to take a ferry to the next port to reach the boat.

Excursions and Activities on Land
We are not affiliated with any excursion companies or promoters on land. We have no financial or other relationship with tour operators. You may participate in land tours and excursions, scooter rentals, cars, bikes at your own risk. All excursions are at your expense.

 

Failure to Pay Booking/Cancellation
If you do not pay the deposit, we will cancel the booking without notice and make the dates available to the public. If you do not pay the balance of the booking price by the required date, we will try to contact you or your broker; however, it is ultimately your responsibility to pay the balance by the agreed date.

Damage and Unexpected Costs
There are some rules that must be followed, and it is important to bring them to your attention before the trip to minimize the possibility of things going wrong and incurring unexpected charges.

While you are in a marina, you are not allowed to use the toilet (WC); you should use the facilities at the marina. If dirty water is discharged from the boat into the port, the skipper may be fined for this. This charge will be passed on to you.

It is absolutely forbidden to flush toilet paper, hygiene products, or foreign objects (including hair, especially long hair) through the toilet or shower pump. Any blockages will be charged to the client at a rate of €250 for a clogged toilet.

If you damage the boat or its inventory, you will cover the replacement and repair costs.

Changes

  • We reserve the right to modify these terms and conditions at any time without notice.

  • We reserve the right to change the pricing structure of our tours without notice.

  • We reserve the right to change any part of the itinerary, regardless of whether we have published the changes online or not.

  • Departure is guaranteed with a minimum of 2 passengers unless otherwise specified.

Cancellation by Us
We aim to have a zero cancellation policy; however, sometimes cancellations may be unavoidable, and we reserve the right to do so. Any cancellations will be communicated to the Traveler as soon as possible before the departure date.

We offer you a choice between the following:

  • Rescheduling the booking

  • A voucher for the amount paid

N.B. We will not refund any other associated costs such as flights and transfers.

 

Force Majeure
In this clause, "Force Majeure Event" means an event beyond the control of the Authority and the Operator, which prevents a Party from fulfilling any of its obligations under this Contract, including but not limited to: Acts of God (such as, but not limited to, extreme weather conditions, fires, explosions, earthquakes, droughts, tsunamis, and floods), war, hostilities (regardless of whether the war is declared or not), invasion, acts of foreign enemies, mobilization, requisition, or embargo, rebellion, revolution, insurrection, or military or usurped power, or civil war, contamination from radioactivity resulting from any nuclear fuel or any nuclear waste from the combustion of nuclear fuel, toxic radioactive explosives or other hazardous properties of any explosive nuclear group or nuclear component of such a group, riots, disturbances, strikes, slowdowns, travel restrictions or bans, lockdowns, public health bans or restrictions, pandemics, lockdowns or disorder, unless limited solely to the employees of the supplier or its subcontractors, acts or threats of terrorism, recession, depression, any unspecified global natural or man-made disaster, cyber terrorism, cyber pandemics, global financial crisis, blockade of the global banking system including but not limited to the blockade of electronic transactions, cash withdrawals, or economic collapse.

Force majeure events in neighboring countries that do not affect the host country do not qualify as valid reasons for rescheduling, and our standard cancellation policy applies.

In the event that Stay Salty Ammare is unable to perform the contracted services for reasons beyond our control, we will not be held liable. The trip does not extend to another week. We remind you that travel insurance is recommended for all guests to cover you in case of emergencies beyond our control that prevent us from providing the service.

In case of emergency repairs during your itinerary, it may be necessary to spend an extra day at a particular location. This is unforeseen and unavoidable, and no monetary compensation will be provided for a change in the itinerary. The skipper will discuss the options with the group and make a decision on how to optimize the time.

If winds are excessive/forecasted to exceed 25 knots, the boat must find shelter and is not authorized to leave the safety of the marina/bay. This will result in a change to the itinerary. We will always prioritize your safety, even if it means altering your itinerary.

The itinerary is a proposed itinerary, and if the weather does not allow for safe passage, it may result in a modified itinerary, including staying in port. Any additional water taxis/ferries to proceed to a proposed port are at the guests' expense.

 

Meals
We provide the preparation of 2 lunches and 2 dinners on full days during your holiday, excluding boarding and disembarkation days. On boarding day, we offer a welcome aperitif after all guests have checked in. We also offer cooking classes.

 

We include a galley gift box in the offer, which will be used for the welcome aperitif and for the cooking classes. Any products made during the cooking classes will be considered part of the lunches and dinners prepared by the crew.

Guests are required to share cooking duties for all other meals with the crew. In the event that the majority of guests decide to visit a local restaurant, the crew is not obliged to pay their share of the bill.

Please promptly communicate any allergens. Otherwise, the Travel Organizer will not be responsible in case of allergic reactions.

 

Liability
Stay Salty Ammare operates in accordance with local laws and regulations. All due attention will be paid to ensure the safety of your personal belongings; however, the travel organizer will not be held responsible for replacing your personal belongings in the event of theft or burglary on the yacht. It is your responsibility to obtain adequate travel insurance before boarding, covering personal belongings and against any injuries.

Stay Salty Ammare will not be held liable for any injuries due to negligence or accidents caused by the guest. Sailing is an active sport with variables such as wind, water, moving objects, and other vessels. All assistance will be provided, and guest safety is the skipper's priority; however, the travel organizer will not be held responsible for any unforeseen incidents resulting in injury to guests.

Guests may not wish to participate in active sailing; however, by boarding and embarking with us on a sailing holiday, you assume all associated risks, including but not limited to cuts, bruises, sprains, broken bones, or rope burns, and similar variables.

 

Authority of the Skipper and Dispute Resolution
The skipper has the final word and the highest authority aboard the sailing boat. All guests must always respect each other, including but not limited to each guest's personal space, personal belongings, quiet time in the morning and afternoon, allowing other guests to sleep if they have retired to their accommodations for the evening, and respecting opinions.

If the skipper's involvement is required in resolving disputes, their word is final. If an individual or group refuses or is unable to meet the skipper's requests, they may be asked to leave the tour with immediate effect. If a person or group is removed from a tour, it is their responsibility to find subsequent transport and accommodation. No refunds will be provided.

You will be responsible for any damages or losses caused by you or members of your group while aboard. If it is deemed that you or any member of your group, in our reasonable opinion, behaves in a way that could cause danger or discomfort to others or property, we have the right to terminate our agreement with the person(s) involved without notice or refund. We also have the right to remove the person(s) involved from the vessel and have no further liability towards said person(s).

If the circumstances are serious, local police may be involved.

The skipper's decisions are final. In case of disputes or misunderstandings, the skipper's decision must be respected.

 

Rights and Use of Digital Media
If a photographer or other staff member is taking photographs/videos and you object to their use by us, please make your objection known at that time. We may publish digital media on a web platform and/or use them for marketing purposes.

 

Personal Responsibilities
All persons intending to travel must be at least 18 years old from the date of departure or be under the supervision of their legal guardian (i.e., a parent).

Your personal responsibilities include, but are not limited to:
Travel visa (if required)
Current and valid passport/ID
Arranging travel to and from the embarkation and disembarkation ports/marinas
You are responsible for notifying your skipper or the travel organizer if you or any members of your group are late for check-in
Your personal safety onboard and in port
Bringing all medications for any illnesses or conditions
Informing the skipper of any physical or medical conditions
Informing your skipper if you cannot swim or suffer from medical conditions including but not limited to panic attacks, diabetes, heart issues, blackouts, or epilepsy.
Following all instructions provided by your skipper
Treating the boat and equipment with care, including personal cleanliness, maintaining the cabin and toilet clean, and keeping common areas tidy and orderly
It is the parents' responsibility to clean up after their children
Reporting any cases of other guests abusing the sailboat or guests' property
You are responsible for personal items, and the Company is not liable for any losses.

It is your responsibility to verify that you have all your belongings before disembarking from the sailboat. If you leave personal items on the boat, you will need to contact the crew as soon as possible. If we identify forgotten items, you will be asked to pay for registered mail to have the items shipped to you. We are not responsible for any items that do not arrive by mail.

 

Our Obligations
Our obligations are to provide a boat according to the specifications indicated in the offer.
Any failures of the boat or complaints with the crew must be reported to the captain or back office. We have 24 hours in national waters or 72 hours in international waters to resolve issues or offer alternative activities. If problems are not reported, we are not responsible for any financial compensation after the fact; we require the opportunity to rectify them during the rental. We will not be responsible for any delays caused by force majeure or adverse weather conditions.

We are not responsible for any additional costs incurred by the customer outside of the rental, e.g., hotels, transfers, flights, damages incurred, etc.

Disputes
If during the trip the customer has complaints, they must communicate them immediately. Furthermore, the customer is required to do everything possible to cooperate in removing the cause of the disturbance and contain any damages. This is a necessary prerequisite for the subsequent activation of any rights to compensation and also allows, in most cases, to resolve the situation. Any failure in the execution of the contract must be contested by the customer during the rental by submitting a timely complaint so that the representative of Stay Salty Ammare and the escorts can promptly remedy it. Otherwise, compensation for damages will be reduced or excluded.

 

Additional Costs
If you anticipate needing a water taxi, those costs will be your responsibility. Guests are required to pay any entrance fees or other excursions off the boat unless specifically mentioned in the "price includes" section of the offer.
